A month for a refund???

My account was overcharged and I'm due for a refund of $136.25. Was told to wait 24 hours, call back and they would issue me a refund. Called today and was told that I have to wait A MONTH to get the $136.25 that was taken out on my account? And the guy called me an ugly name when I asked to speak with someone else. How is it legal to hold a mischarge for a month?
