Modem issues

Hello, my system light went out on my modem and transmit light was blinking, I was without internet for several days, had a tech scheduled and never showed up or called, rescheduled and once again never showed.  My system light is back on and I have internet though the transmit light still blinks and I will lose internet for awhile.  My question is can a new modem be sent to me, since the techs don't bother to show? Thank you
